We are still counting that the charges on my brother will be reduced on his misdemeanor DUI case here in Albuquerque, New Mexico. This is his first DUI offense and if he will be convicted, what are the penalties that are involved?

If your brother will be convicted for his first misdemeanor DUI offense in Albuquerque, New Mexico, he will be imprisoned for not more than 90 days or pay a fine of not more than $500, or both; provided that if the sentence is suspended in whole or in part or deferred, the period of probation may extend beyond ninety days but shall not exceed one year. He may also have a sentence of not less than 48 hours of community service or a fine of $300.
He will also be ordered by the court to participate in and complete, within a time specified by the court, an alcohol or drug abuse screening program approved by the Department of Finance and Administration and, if necessary, a treatment program approved by the court. This requirement shall not be deferred, suspended or taken under advisement. He would also have to attend a driver rehabilitation program for alcohol or drugs, also known as a DUI School.
