Auto Insurance Claim New Mexico NM
Reader’s Question:
I know that I have to inform my auto insurance company here in New Mexico about an accident wherein I was at-fault. But if it wasn’t me who caused the accident, do I need to still tell my insurer about it?

If you get involved in an auto accident, the other driver’s car insurance company may tell you that you have to ask for payment or file a claim from your own auto insurance provider in New Mexico because there was no proof that it was the other driver’s fault. This would be the very reason why it is such a great idea to inform your car insurance provider about the auto accident right away after it happened–even if it was not you who caused the accident. Even though it is illegal for majority of the states for a car insurance provider to deny claims with no reasonable investigation of the facts, or to deny claims even if the legal responsibility is credibly apparent, you may not be fascinated in going to battle against the other driver’s insurer.
In case you want to face the at-fault driver’s car insurance company, getting the service of an attorney could be a great idea, especially if you sustained a serious injury. An experienced lawyer could be able to explain to you the laws about car insurance and fight the battle with you against the other driver’s insurer. However, remember that in case you make a decision to hire a lawyer, he/she would take his/her share of the settlement if you ultimately win the battle.
